These general terms and conditions of sale apply to day trips organized by Arnauld D’Heeger (Mountain Leader) under the trade name “Chemins Occitans,” based at 10 Rue Lancefoc, 31000 Toulouse; email: chemins.occitans@gmail.com; tel.: 06 26 23 81 25 (SIRET No.: 878 247 519 00019).

Article 1: Services

Mountain hiking or snowshoeing, without altitude limits, excluding terrain requiring the use of mountaineering equipment or techniques (rock climbing, glaciers, skiing, etc.).

Article 2: Booking/Cancellation/Payment

Booking

Day trips can be booked via the Chemins Occitans website by selecting a trip from the “Events and Rates” page. Exceptionally, bookings may also be made by phone (06-26-23-81-25) or email (chemins.occitans@gmail.com), provided the following details are supplied: the full name, email address, and mobile phone number of the person making the booking, as well as the full name of each participant included in the reservation.

Cancellation

Cancellation by the customer

Reservations must be cancelled via the website by accessing the “Manage my reservations” section of the customer account at least 2 business days prior to the scheduled hike. In the event of cancellation less than 48 hours before the outing, Chemins Occitans reserves the right to charge a €15 administrative fee.

Excessive cancellations

In the event of more than two late cancellations (e.g., two cancellations made less than 48 hours in advance within a six-month period), Chemins Occitans reserves the right to require prepayment for any future bookings. The customer will be notified of this via email prior to the confirmation of their next booking.

Cancellation or modification by Chemins Occitans

Chemins Occitans may cancel a scheduled hike in the event of *force majeure* (dangerous weather conditions, failure to meet the minimum number of participants, etc.). In such cases, Chemins Occitans may offer:

  • an alternative hike of an equivalent level (e.g., in an area with more favorable weather conditions);
  • rescheduling the hike for a later date;
  • outright cancellation.

The client will be notified at least 12 hours in advance and receive a full refund of any amounts paid if they do not wish to accept a credit or the proposed alternatives (rescheduling or itinerary modification). During the excursion, the guide retains authority over the itinerary and may decide to modify its content at any time for safety reasons.

Payment

Payment is made on the day of the outing in cash, by check (made payable to Arnauld D’Heeger), or by phone (06-26-23-81-25).

Article 3: Physical health requirements

Access to the Activity may be subject to physical or experience-related prerequisites. Each outing carries a difficulty rating (see description) in accordance with the recommendations of the French Hiking Federation (Fédération française de la randonnée pédestre). It is the Client’s responsibility to verify that they meet the prerequisites corresponding to the outing’s rating. Any Client who falsely claims to meet these prerequisites—and whose actual physical fitness or experience level falls below what was declared—bears full responsibility for any consequences of any kind that may arise. In particular, the Client must disclose to the Guide any health issues, medical history, short-term or long-term treatments, or past accidents that could affect their physical or mental health, as well as any specific apprehensions (such as vertigo, history of accidents, fears, etc.) related to the booked activity.

Article 4 : Insurance

Your guide holds professional liability insurance covering the proposed activity. However, each participant is advised to verify that they have personal liability insurance and, if they wish, assistance/repatriation insurance suited to the activity. For mountain-based activities in particular, it is recommended to verify coverage for any rescue, search, evacuation, or transport costs that may be incurred.

Article 5 : Loaned Equipment

In the event of damage caused by improper use of loaned equipment (e.g., hiking poles, snowshoes, binoculars, etc.) or in the event of loss, the client may be required to pay compensation for wear and tear or the full replacement cost of the equipment.

Article 6 : Image rights

Authorization for image use: The Client authorizes Les Chemins Occitans to use—without time or geographic limitations—photographs taken by Les Chemins Occitans guides or submitted by the Client to Les Chemins Occitans in connection with the service, for promotional purposes (website, social media, print materials, etc.).

Exception: This authorization does not apply to images featuring identifiable faces, unless expressly agreed to by the Client or the individuals concerned.
